The insurance covers the legal liability of the policyholder arising from the freelance activity as a German patent attorney and as a member of the European Patent Institute (and), as well as the activity before the European Union Intellectual Property Office (EUIPO) and the World Intellectual Property Organization (WIPO).

The insurance cover does not apply to liability claims arising from activities through law firms or offices established or maintained in other states, from activities in connection with the provision of advice and dealing with non-European law and from the activities of the patent attorney before non-European courts.

Rules of Professional Conduct of the Fédération Internationale des Conseils en Propriété Intellectuelle (FICPI)

The professional regulations of the Patent Attorneys’ Code of Conduct and the Professional Code of Conduct of the Patent Attorneys can be viewed and downloaded from the homepage of the Patent Attorneys’ Association (www.patentanwalt.de), the Code of Conduct of the Fédération Internationale des Conseils en Propriété Intellectuelle (FICPI) can be viewed and downloaded from its homepage (www.ficpi.org).

Acceptance of mandate

Patent attorneys are prohibited from representing conflicting interests by professional regulations (Section 39a (4) Patent Attorneys’ Regulations). Before accepting a mandate, it is therefore always checked whether a conflict of interest exists.

In any case, the acceptance of a mandate requires the express confirmation of one of the patent attorneys authorised to represent the partnership with limited professional liability.

Out-of-court settlement of disputes

In case of disputes between patent attorneys and their clients, there is the possibility of an out-of-court settlement of disputes at the Chamber of Patent Attorneys upon request (Sec. 69 (2) No. 3, (5) Patent Attorneys’ Regulations).

We are not legally obliged to participate in dispute resolution proceedings before a consumer arbitration board. We therefore ask for your understanding that we generally exclude our participation in such dispute resolution proceedings.
